The appellee filed in the commissioners’ court of Cass county a claim for compensation for collecting and disbursing the special school tax, which had been received and paid out by him as the treasurer of the said county. The board refused to allow his claim, and he appealed to the circuit court, and there recovered judgment.

In the circuit court the appellant entered a special appearance and moved to dismiss the appeal. This motion was overruled, and upon that ruling error is assigned. The ground of the motion is that no summons was served upon the commissioners. It was not necessary that any…
