Mabry, J.:

The plaintiff in error was plaintiff in the court below. The action he brings is trespass on the case on promises, based upon a written contract, a copy of which is filed with the declaration. There are three counts in the declaration. In the first count it is ■ alleged that defendants agreed to take and pay for, cash upon delivery, and at the prices mentioned in the contract, all the perfumes and beverages which plaintiff should produce of his own manufacture during the period of one year, beginning February 6th, A.
