HUTCHESON, Circuit Judge.
Appellant, a holder of some of the first and refunding mortgage bonds of the Florida East Coast Railway, unwilling to intervene in the consolidated causes already pending in the same court in which, at the suit of the creditors and at that of the mortgage trustees, the railway company was being administered by receivers, brought this suit as he claims, as ancillary and dependent to it.
