Greg Starr, Esq. petitions this court, pursuant to Judiciary Law § 475, for a determination on a fee dispute with Harry Issler, Esq. The lawyers had executed a fee sharing agreement at the inception of this medical malpractice action that was settled shortly before trial. The dispositive issues before this court are: (1) whether the fee sharing agreement was extinguished when Mr. Starr signed a new retainer agreement with the client, purportedly making him the new attorney of record and removing Mr. Issler from the case, and (2) if not, whether the fee…
