Plaintiff David F. Kunz (“Kunz”) filed this action on January 18, 2005 against Defendant New York State Commission on Judicial Conduct (“Commission”), Robert Tembeckjian (“Tembeckjian”), New York State Office of Court Administration (“OCA”) and the Honorable Jan H. Pluma-dore (“Justice Plumadore”) (collectively, “Defendants”), pursuant to 42 U.S.C. § 1983, alleging violations of his constitutional rights to due process, equal protection, and free association.
