I think the appeal should be dismissed.

On October 8, 1943, R. H. Siegfried Company brought an action on a promissory note against Tankersley Investment Company in the district court of Tulsa county. Earl Tankersley, by leave of court, filed a petition of intervention in said action setting up that he was the owner of one-half of the stock of said corporation; that his brother, Dan Tankersley, was the owner of the other one-half of' the capital stock and that Dan Tankersley was neglecting or refusing to defend the action and was attempting to exclude Earl Tankersley from all participation in…
