Henry A. Fowler, as administrator of the estate of Edward S. Allen, deceased, brought an action on the case in the circuit court of Cook county against the Chicago Railways Company, plaintiff in error, and the city of Chicago, to recover damages sustained by Allen’s next of kin by reason of his death, which, it was alleged, was occasioned by the negligence of plaintiff in error and the city of Chicago in failing to repair a street in the city of Chicago.
