Defendant James Lee Stearns, aged 23, was charged with breaking and entering in tbe nighttime. It was alleged that the offense occurred July 21, 1961. He was ar*707raigned in municipal court on August 7,1961, waived examination, and was bound over to circuit court. On August 16, 1961, be was arraigned in circuit court.
