The instant case is before the Court upon the appeal of Petitioner Steven 0. Dale, Acting Commissioner of the Division of Motor Vehicles (“Commissioner”), from a June 15, 2013, order of the Circuit Court of Marshall County, reversing a final order of the Office of Administrative Hearings (“OAH”) that upheld the Commissioner’s order revoking Respondent Donald Oakland’s privilege to drive a motor vehicle.
