This is an application for an injunction pendente lite. The plaintiff and defendant are the owners of adjoining properties situated on West Thirty-fifth street, near Eighth avenue, in the borough of Manhattan. On their mutual dividing line, and located partly on the premises of each, stands a party wall from eight to twelve inches in thickness which is now the west wall of the building on the plaintiff’s lot.
