OPINION
McKEAGUE, Circuit Judge.
While Petitioner Sandy Glover was awaiting trial in Livingston County Jail on various charges arising from the alleged assault of his ex-wife, 1 he was implicated in the assault of another inmate at the jail. He was convicted of the jail assault in a jury trial. Glover retained trial counsel to pursue his appeal of right, but the attorney failed to timely file a notice of appeal.
