This matter comes before us on a motion for partial summary judgment in a tort liability action filed by Danny Cruz and Maty Rodriguez (hereafter, “defendants”), requesting Alexandra *62Bridgeman (hereafter, “plaintiff”), be precluded from recovering non-economic damages pursuant to the Motor Vehicle Financial Responsibility Law.
