The appeal is from the order denying a new trial.

The practice here pursued is not to be commended. The large amount involved may furnish some excuse. Appellant, H. V. Mercer, filed a claim in the probate court of Hennepin county against the estate of Thomas Barlow Walker, deceased, for legal services in a suit for an accounting brought by Walker, wherein the representatives of the estate of Healy C.
