— Appeal from a judgment of the Supreme Court (Cardona, J.), entered October 30, 1991 in Ulster County, which, in a proceeding pursuant to CPLR article 78, dismissed the petition as untimely and for lack of personal jurisdiction.

Petitioner requested expungement of all determinations finding him guilty of violating disciplinary rules between January 1, 1983 and April 22, 1985, claiming that the Department of Correctional Services had not properly filed the applicable rules pursuant to NY Constitution, article IV, § 8.
