The accused is a Samoan who has served about five years in the United States Navy. He was brought before a general court-martial convened in Pearl Harbor, Hawaii, on charges of premeditated murder, attempted murder, and assault with intent to inflict grievous bodily harm, in violation of Articles 118, 80, and 128, respectively, of the Uniform Code of Military Justice, 10 USC §§ 918, 880, 928.1 He was represented by appointed military counsel and Talking Chief Manaea of Laulii, Island of Tutuila, American Samoa, who by Samoan custom “acts as an…
