LATCHUM, Chief Judge.
Alleging copyright and patent infringement, trademark violations, and unfair competition, Wylain, Inc. (“plaintiff”) has sued Kidde Consumer Durables, Inc. (“defendant”). The defendant has moved pursuant to Rule 12(b)(7), F.R.Civ.P., to dismiss the action1 because plaintiff failed to join indispensable parties under Rule 19, F.R. Civ.P.2
