This action was brought by plaintiff, the holder of preferred stock in the defendant corporation, seeking an adjudication that all of the preferred stock issued by deféndant should he held to be due and payable, and that the holders of said stock were entitled to share pro rata in the corporate assets, and to enjoin the defendant from redeeming and retiring its preferred stock in the order of its maturity.
