HUDDLESTON, Judge.

This appeal involves a dispute over the surname of a child bom out of wedlock. The facts are undisputed. In 1993, a child was bom as a result of the union of Diana Hazel and Robert Wells. At birth, the mother chose to give the child her surname (Hazel). Shortly after the child’s birth, Wells filed a petition in Jefferson Family Court to establish paternity and to have the child’s surname changed to Wells.
