MEMORANDUM AND ORDER

This matter is before the Court on Plaintiffs (“Trustee”), motion for summary judgment. Defendants (“Enodis”) submitted their own motion for summary judgment. Both parties submitted briefs in opposition to the others’ motion for summary judgment. This Court heard oral argument in this matter in Lafayette, Indiana on October 7, 2002.
