The motion is made by the plaintiff to obtain an injunction pending final judgment in the action. The plaintiff is the publisher of two newspapers, one known as the New York American and the other known as the New York Evening Journal. The defendants are the mayor and the aldermen and the police commissioner of the city of Mount Vernon. The *632complaint alleges that the papers named have a circulation respectively of several hundred thousand copies and that there have been sold in the city of Mount Vernon within the last month a large number of thousands, specifying the exact number of thousands…
