Appeal from an order and judgment of the Supreme Court (Drago, J.), entered November 19, 2008 in Schenectady County, which granted plaintiffs cross motion for, among other things, an award of counsel fees.
The underlying facts of this matter are more fully set forth in our prior decision affirming a 2005 Supreme Court judgment granting plaintiff a divorce on the basis of cruel and inhuman treatment, and ordering equitable distribution of the parties’ property (Xiaokang Xu v Xiaoling Shirley He, 24 AD3d 862 [2005], lv denied 6 NY3d 710 [2006]).
