This case presents three issues. First, is the Oregon State Bar (the bar) a “state agency” or an “other public agency of this state” under the Public Records Law, ORS 192.410? Second, does the application of the Public Records Law in this case violate the separation-of-powers provisions of Article III, section 1, of the Oregon Constitution? Finally, does application of the Public Records Law here unduly interfere with judicial functions in violation of Article VII (amended), section 1, of the Oregon Constitution?
