TINDER, Circuit Judge.

Melvin Newman was convicted in Illinois state court of first-degree murder of Andrew Dent and sentenced to 47 years’ imprisonment. Following affirmance of his conviction and sentence on direct appeal, Newman filed a state post-conviction petition, asserting three grounds for relief, only one of which is relevant here. The Illinois Court of Appeals affirmed the circuit court’s dismissal of his petition, with one justice dissenting, and Newman exhausted his state court remedies.
