MEMORANDUM DECISION
FRANK MAAS, United States Magistrate Judge.
This suit, brought on behalf of J.T., a child with learning disabilities, by his parents, W.T. and K.T. (“Parents”), seeks review of a decision by the New York State Review Officer (“SRO”), which found in favor of the New York City Department of Education (“DOE”) and denied reimbursement of J.T.’s private school tuition for the 2007-2008 school year. 1 The Parents have moved for modified de novo review of the SRO’s decision, which is, in effect, a mo tion for summary judgment.
