This case is before the Court on appeal by the petitioner, George K., of the February 21, 2012, order of the Circuit Court of Taylor County which found pursuant to W. Va.Code § 27-6A-3(h) (2007) that George K. is not competent to stand trial, that he is not substantially likely to attain competency, and that the charges against him — two counts of third degree sexual assault pursuant to W. Va.Code § 61-8B-5(a)(2) (2000) and two counts of sexual abuse by a custodian pursuant to W. Va.Code § 61-8D-5 (2005) — involve an “act of violence against a person.” The circuit court…
