STOKES, Justice.

This case is before us upon a motion of appellee to dismiss the appeal upon the ground that the appeal bond was not filed within the time prescribed by law and this court, therefore, does not have jurisdiction of the appeal. The record shows that the case was tried at the November term, 1939, of the district court of Wheeler County. The trial began on December 18, 1939, and judgment was rendered by the court upon the verdict of the jury December 29, 1939.
