STOKES, Justice.
The appellee, H. E. Hoover, was the owner of certain oil and gas leases, covering 3,000 acres of land in Cooke county. At some time prior to February 11, 1936, he entered into a contract with appellant, Malcolm W. Morse, under the terms of which appellant agreed to finance the drilling of a test well on the leases in an effort to discover and produce oil or gas.
