The appellee bank sued appellant Holt and the Citizens’ State Bank of Wheeler to recover the amount due upon a check in the sum 'of $802.78, which Holt had given, payable to the order of James Cook, and which Cook had Indorsed to appellee.

The appellee alleged that in issuing the check, Holt had acted as the agent of the Citizens’ State Bank; that Cook presented said check to plaintiff hank at its place of business in Miami, duly indorsed, and was given credit for the amount thereof, less $91.-95 due on a note which plaintiff bank held against Cook’s son and which Cook agreed to pay.
