WALL, United States Magistrate Judge.
Before the Court is a motion for partial summary judgment by the defendant, Aet-na Life Insurance Company, seeking dismissal of plaintiff Courtien Communications’ First Claim for Relief, sounding in breach of contract, “to the extent that said claim seeks damages based upon any telecommunications services provided to Aetna by AT & T,” and dismissal of the Second Claim for Relief, sounding in unjust enrichment, in its entirety.
