Educational Testing Service (“ETS”) appeals from an order entered January 5,1996, awarding appellee Jeffrey A. Mints $8,436.78 in attorney’s fees and costs pursuant to 28 U.S.C. § 1447(c) (“section 1447(c)”), Mints initiated this action in the Superior Court of New Jersey, but ETS removed the case to the district court under 28 U.S.C. § 1441(b). ETS asserted that the district court had removal jurisdiction because, in its view, the case arose under the laws of the United States, in particular the Employee Retirement Income Security .
