MORRISON, Presiding Judge.

The offense is aggravated assault with a motor vehicle; the punishment, 30 days in jail and a fine of $250.00.

The witness Monk testified that on the day in question he was driving his automobile north out of Dallas when a Ford approached from his rear and passed him on the shoulder of the highway to his right; that the Ford was driven by a man, who was the sole occupant; that, after it had passed, the Ford hit a mud hole; that the driver “lost control of his car and careened back across the highway” and “hit this other car,” which was traveling south into Dallas;…
