McDONALD, Judge.

Appellant was convicted in the county court of Van Zandt Countjr for driving a motor vehicle on a public road, while intoxicated. His punishment was assessed at a fine of $100 and confinement in jail for thirty days.

The witness Saxton testified that on the night of July 4, while at home, he heard a noise which sounded like a “car collision” and went to investigate, and that he observed an automobile sitting “crossways” about four or five feet from the pavement on the road running from Grand Saline to Alba, and the appellant lying on the ground on the driver’s side about eight…
