Appeal by the plaintiff, The Security Bank of New York, from an order and determination of the Appellate Term of the Supreme Court, entered in the office of the clerk of the county of New York on the 7th day of March, 1913, affirming a judgment of the City Court of the City of New York in favor of the defendant entered upon the verdict of a jury, and also affirming an order of said court denying plaintiff’s motion for a new trial.

This is an action on a promissory note made by the defendant on the 3d day of January, 1906, for $2,005.35, payable on demand to the order of the plaintiff under its former name, which was the Fourteenth Street Bank, with interest, to recover a balance of $375.67. The action was commenced on the 19th day of February, 1912. It is alleged that there were payments made to apply on the note as follows: January 8, 1906, $502.67; June 13, 1906, '$751.34, and March 28, 1907, $375.67.
