Plaintiff-appellant, Louis W. Rodgers, appeals from the judgment of the trial court granting summary judgment to defendants-appellees, village of South Russell and Patrolman David Ferrell.

On December 6,1988 at approximately 1:00 a.m., appellant was a passenger in an automobile driven by defendant, Robert C. DeRue, who was being pursued in a high-speed chase by appellee Ferrell, a police officer employed by South Russell.
