The Municipal Civil Service Commission conducted the written promotion examination in question for the position of sergeant of the New York City Police Department. About 7,000 candidates took the examination, including the 111 petitioners and the 117 intervening defendants. The examination consisted of ninety “ multiple choice ” questions.
