Per Curiam :
This suit was commenced before a police magistrate of Knox county, by the plaintiff in error against the defendant in error, to recover certain moneys paid as initiation fees.
Appeal was taken from the judgment of the police magistrate to the circuit court of Knox c ounty, and, on the trial in that court, the case was submitted on the following agreed statement of facts :
