This is the third appeal that defendant-appellant Patrick Vigneau (‘Wigneau”) has brought before this court in relation to his March 1998 convictions on multiple federal charges for his participation in a drug distribution scheme. Vigneau argues that (1) there was an error in his sentencing which resulted in an additional 38 months incarceration; (2) the district court’s sentence exceeded the statutory maximum in violation of Apprendi v.
