Judgment of Supreme Court, New York County (George Bundy Smith, J.), entered May 8, 1985, dismissing the petition, unanimously modified, on the law, to reinstate the petition to the extent of directing the Chancellor to make a determination, and otherwise affirmed, without costs and without disbursements.
