Before the Court is plaintiffs’ [19] motion to"’alter or amend this Court’s judgment of July 30, 2013 and for leave to amend their complaint, both of which the EPA opposes. Plaintiffs, three New Hampshire cities, filed a complaint alleging that the Environmental Protection Agency (“EPA”) failed to perform nondiscretion-ary duties under the Clean Water Act, 33 U.S.C. § 1365(a)(2) (“CWA”).
