DOBIE, Circuit Judge.

Ambrosia Chocolate Company, a Wisconsin corporation, brought a civil action in the United States District Court for the Middle District of North Carolina against Ambrosia Cake Bakery, Inc., a North Carolina corporation, in which plaintiff sought to enjoin defendant from infringing plaintiff’s registered trade-mark “Ambrosia”. Plaintiff ha9 appealed to us from a judgment of the District Court dismissing the complaint.
