Rulon, C.J.:

The State appeals the district court’s dismissal of one count of aggravated endangering a child filed against defendant Monica Hernandez after the preHminary hearing. We affirm.

On May 7, 2007, the defendant told the police she allowed her son A.J. (d.o.b. August 19, 2005) to play in their front yard with several older children while the defendant was inside cooking dinner.
