For the sake of brevity, the plaintiff in error will be referred to as the defendant. The defendant and Will Barker, the person killed, were neighbors,' living about four miles southwest of the town of Benning-ton, in Bryan county. About two or three weeks before the homicide, a male hog belonging to the deceased got out of his pen and strayed onto the premises of the defendant’s father, with whom the defendant made his home.
