The defendant was indicted, tried and convicted in the county of Chemung, for an offence committed in the town of Catharine, in that part of the former county of Chemung, now, and at the time of the perpetration of the crime, constituting a part of the contested county of Schuyler, and at a place confessedly more than five hundred yards from the division line between the two counties. He was convicted at a Court of Oyer and Terminer, held in the county of Chemung, and the conviction was affirmed at a general term of the Supreme Court in the sixth judicial district.
