This is an appeal from a judgment obtained by the plaintiff in an action to recover damages for personal injuries alleged to have been caused by the negligent operation of a crane while unloading heavy steel I-beams from one of defendant's cars in its yard at Flint, Michigan.
The case has been tried three times. The judgment entered in the first trial was reversed by this court in 253 Mich. 144. The second was a mistrial.
