Reversing.

When this case was here on the former appeal (Riggsby v. Swiss Oil Corporation, 240 Ky. 543, 42 S. W. [2d] 732, 736), the principal issue was the construction to be given the oil and gas lease as modified by an agreement made by the parties in compromise of their differences respecting its terms. It was held that the obligations extended beyond 1926, which was the expiration of the definite ten-year period stipulated.
