CHRISTIE, District Judge:
This diversity matter is before the Court on the respective motions of the defendants to dismiss.
The gravamen of the complaint is that on or about April 14, 1969, the plaintiff was employed for the term of one year as an assistant football coach at Marshall University, a state institution of higher learning, operated under the jurisdiction of the defendant, The West Virginia Board of Regents, with the defendant, Roland H.
