ORDER

HADEN, District Judge.

This is an action brought under the diversity jurisdiction of this Court, 28 U.S.C. § 1332, for the recovery of monetary damages for injuries sustained as a result of the alleged negligence on the part of the Defendants. The Plaintiff, Hector Santiago, is a jockey, who on November 24,1973, was participating in a horse race at the Shenandoah Downs Race Track in Charles Town, West Virginia.
