MEMORANDUM AND ORDER

WEXLER, District Judge.

This is a civil rights action commenced by Christopher Bodkin (“Bodkin” or “Plaintiff’) alleging a violation of state law and of Plaintiffs rights pursuant to the Fourteenth Amendment to the United States Constitution. Named as defendants are Robert Garfinkle (“Garfinkle”) the Republican member of the Suffolk County Board of Elections (“BOE”) and Anita Katz (“Katz”), the Democratic member of the BOE (collectively “Defendants”).
