The defendant, Christopher G. Tucker (Tucker), appeals from the denial of his motion to correct an allegedly illegal sentence. The issue raised on appeal is whether the Superior Court exceeded its authority under G.L.1956 § 12-19-9 when, after adjudging Tucker to be a probation violator, it removed the suspension from a portion of his original sentence and committed him to prison to serve only that portion, while continuing to suspend the rest of his previously imposed sentence.
