— The complaint alleges that the defendant is and has been engaged in the real estate business in the city of Indianapolis for a number of years, operating in the name of Thomas F. Carson and Company; that in the latter part of the year 1926, the plaintiff, and defendant entered into an agreement whereby the plaintiff was to attempt to sell real estate on a commission and maintain his office in the office at the time occupied and maintained by the defendant; that in all sales made by plaintiff, the commission was to be divided evenly between plaintiff and defendant, and that plaintiff was not…
